City Council Meeting September 12 2023

 

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, SEPTEMBER 12, 2023

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 12th day of September at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Smith; Council Members: Anderson, Born, Janovec and Sanne Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Kyle Petersen was present as City Attorney

 

Janovec moved to approve the meeting minutes from August 8th and August 29th. Sanne seconded the motion. Motion carried 4-0.

 

Sanne moved to approve claims and payroll. Janovec seconded the motion. Motion carried 4-0.

 

Juleen Johnson reported that the Manor health insurance was finalized and coverage with Aetna will begin on October 1st. The board decided to table any action on Nebraska CLASS investment pool until the City Council had made a decision.

 

Police Chief Hallock reported that 20 nuisance properties have been served. Traffic citations are up with an increase in speeding violations reported. A reminder on the rules and regulations for golf cart use in City limits was given. The bike rodeo was held on August 19th with 12 kids participating and all had a fun time.

 

Susan Norris gave updates on continuing projects for county economic development.

 

City Superintendent report was given by City Administrator Tarr.

 

No City Attorney report was given.

 

The Mayor had one board appointment.

 

Bernice Yilk was recommended for the library board for a term to end June 2024. Sanne moved to approve the appointment. Born seconded the motion. Motion carried 4-0.

 

The Mayor opened sealed bids for the Plainview Manor van. One bid was received from Cindy Schlote for $600. Sanne moved to accept the bid. Anderson seconded the motion. The following voted Aye: Anderson and Sanne. Nay: Born and Janovec. Mayor Smith voted Aye to break the tie. Motion carried 3-2.

 

At 7:00 PM Mayor Smith opened the Public Hearing for the Lot Split at 86387 536 Avenue 5 27 4 T.L. 16 16.80 5-27-4 (PT NE 1-4) and Plainview Englers ADD T.L. 13 PT NE1-4 .28 A 5-27-4

 

City Administrator Tarr stated that a lot split had been requested from Cindy Mattern and N&B Gas Company. A portion of N&B’s business is currently on Mattern’s property. Mattern is in the process of selling and the lot split is necessary for N&B to maintain access to their business. The zoning board had recommended the lot split during a public hearing held on September 11th.

 

Born moved to close the public hearing at 7:04 PM. Corrine seconded the motion. Motion carried 4-0.

 

Born moved to approve the lot split at 86387 536 Avenue 5 27 4 T.L. 16 16.80 5-27-4 (PT NE 1-4) and Plainview Englers ADD T.L. 13 PT NE1-4 .28 A 5-27-4. Sanne seconded the motion. Motion carried 4-0.

 

 

Council member Janovec introduced the following resolution and moved for its adoption:

 

RESOLUTION #682

 

A RESOLUTION TO AUTHORIZE THE DEMOLITION OF A STRUCTURE LOCATED AT 107 W. LOCUS AVENUE IN PLAINVIEW AND ASSESS THE COSTS TO THE OWNER OF RECORD

 

WHEREAS, on June 9, 2023, the Police Chief for the City of Plainview, Nebraska, served on Jeff Ratliff, the owner and occupant of 107 W. Locust Avenue, Plainview, Nebraska (hereinafter the “Premises”), a notice that the house/primary structure on the Premises was determined to be an unsafe building and a nuisance (hereinafter the “Notice”);

 

WHEREAS, a copy of the Notice was filed with the Pierce County Register of Deeds on July 14, 2023, as Instrument No. 2023-00729 and indexed against the real estate, which has a legal description of:

Lots Sixteen, Seventeen, and Eighteen in Block One, Pacific Townsite Company’s First Addition to the City of Plainview, Pierce County, Nebraska;

 

            WHEREAS, the Notice instructed the owner of the Premises to remedy the nuisance conditions or demolish the building within 60 days of receipt of the Notice;

 

            WHEREAS, the house/primary structure on the Premises has not been demolished and the nuisance conditions still persist;

 

WHEREAS, the Mayor and City of Plainview deem it necessary that the property located at 107 W. Locust Avenue in Plainview, Nebraska be condemned for the safety of occupants and the surrounding residents; and

 

WHEREAS, the Mayor and City of Plainview desire to initially utilize City funds for the cost of the demolition and removal of the structure.

 

NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:

 

  1. Confirmation. The determination of the Police Chief set forth in the Notice that the structure located on the Premises is unsafe and unfit for human occupancy is confirmed. The owner of the Premises has received notice in conformity with Municipal Code § 9-503 and has failed to comply with the notice and has failed to timely appeal the determination of the Police Chief.

 

  1. Demolition. The City Council hereby orders the demolition of the structure on the Premises.

 

  1. Collection of Costs. The City of Plainview will initially utilize City funds for the demolition and removal of the structure at 107 W. Locust Avenue in Plainview, Nebraska. A statement of costs of such work shall be transmitted to the City Council, at which point the City Council may (1) levy the cost as a special assessment against the lot or real estate upon which the building or structure is located; or (2) collect the cost from the owner of the building or structure and enforce the collection by civil action in any court of competent jurisdiction.

 

  1. Service and Filing. This Resolution shall be personally served on Jeff Ratliff. A copy of this Resolution shall be posted at the premises and shall be filed with the Pierce County Register of Deeds and indexed against the Premises.

 

Council member Sanne seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Anderson, Born, Janovec, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #682 is passed and adopted.

 

Juleen Johnson presented bids she had received for new doors and windows at the Manor. The total from Binswanger Glass was $64,879 and The Glass Edge $67,338. Born moved to approve the bid from Binswanger Glass. Janovec seconded the motion. Motion carried 4-0.

 

Johnson had also received one bid from Riverside Asphalt for $16,515 which would cover the front driveway and parking area by the front entrance to the facility. The council requested that another bid for asphalt and bids for concrete were brought back to the next council meeting to review.

 

The administrative plat for 205 N Pine Street was received from Landmark Surveying which once approved would allow the City to purchase the property from Judy Beaudette. Sanne moved to approve the administrative plat. Born seconded the motion. Motion carried 4-0.

 

 

Council member Born introduced the following resolution and moved for its adoption:

 

RESOLUTION # 681

 

WHEREAS, the Mayor and City of Plainview deem it necessary that Locust Avenue and Main Street are closed to thru traffic from 5:00 PM to 6:30 PM on October 31, 2023 for Downtown Trick or Treating hosted by the Chamber of Commerce;

 

NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:

 

  1. Locust Avenue will be closed from King Street to Elm Street;

 

  1. Main Street will be closed from Locust Avenue to Highway 20

 

 

Council member Anderson seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Anderson, Born, Janovec, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #681 is passed and adopted.

 

A brief discussion on Nebraska CLASS investment pool was held and the council would like to review more before making a decision. Sanne moved to table until the October meeting. Born seconded the motion. Motion carried 4-0.

 

A quote from Leak Investigators was received for repairs to the pool as it was discovered that the return line was broken causing a leak in the pool. Janovec moved to approve the quote for $11,800 Anderson seconded the motion. Motion carried 4-0.

 

Employee wages for FY 2023-2024 were reviewed. City Administrator Tarr stated that all full time employees had been reviewed and a 6% raise was recommended unless otherwise stated. The following proposed wages were presented for approval by the council.

 

Deputy Clerk $20.14 per hour

City Superintendent/Water/Sewer Supervisor $28.39 per hour

City Street Superintendent $26.74 per hour

Solid Waste Supervisor $23.32 per hour

Library Director $18.07 per hour

Police Officer $20.67 per hour

Children’s Librarian $16.00 per hour

Part time Librarian $12.00 per hour

Economic Development Director $18.00 per hour

HandiVan drivers $12.00 per hour

Chief of Police $60,700 annually

City Clerk/Treasurer $55,568 annually

City Administrator $85,466 annually

Mayor $3,000 annually

City Council members $2,000 annually

 

Sanne moved to approve the wages as presented. Janovec seconded the motion. Motion carried 4-0.

 

City Administrator Tarr gave an overview of the FY 2023-2024 budget. Rate increases for monthly trash pickup were discussed with a proposed $3 increase. A purchase of a mini excavator, mulch for the park equipment in Chilver’s, new flooring in city hall, and a snow blower for the skid loader were the major capital purchases to be budgeted. The budget hearing will be held on September 14th at 6:30 PM.

 

Sanne moved to adjourn the meeting. Janovec seconded the motion. Motion carried 4-0
