City Council Meeting May 9 2023

 

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, MAY 9, 2023

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 9th day of May at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Smith; Council Members: Alder, Born, Janovec and Sanne Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Alder moved to approve the regular meeting minutes from April 11th. Sanne seconded the motion. Motion carried 4-0.

 

Mayor Smith asked to remove the claim to Serendipity. Alder moved to approve claims and payroll. Born seconded the motion. Motion carried 4-0. Alder moved to approve the claim to Serendipity. Born seconded. Motion carried 3-0 with Janovec abstaining.

 

Juleen Johnson gave the monthly report for the Manor stating that President Biden will declare the COVID-19 pandemic over on May 11th which will change some policies at the facility. Updates were given on employee health insurance, employee surveys, senior scholarships and CNA classes.

 

Police Chief Hallock reported that during the month of April there had been several burglaries and arrests. Hallock is working with the City of Norfolk building inspector to adopt the International Property Maintenance Code for the City of Plainview to help with nuisance properties.

 

No Economic Development report was given.

 

City Administrator Tarr reported that curb grinding on several properties was completed last week, the City received $38,808 from the recent Big Iron auction, Leak Investigators finished the repairs at the pool and the house at 112 S Elm will be removed prior to Klown Days.

 

City Attorney Curtiss reported that Colby Capital plans to submit all necessary information to the City for the SUP and will attend the June council meeting for final approval. Curtiss also talked about his time as City Attorney over the last 47 years.

 

Mayor Smith presented Curtiss with a plaque in appreciation for his service to the City of Plainview.

 

Mayor Smith made several appointments.

 

Nancy Naprstek was appointed to the library board until June 30, 2024. Born moved to approve the appointment. Janovec seconded the motion. Motion carried 4-0.

 

Ann Spulak was appointed to the pool board through December 2024. Sanne moved to approve the appointment. Born seconded the motion. Motion carried 4-0.

 

Kyle Petersen was appointed as the new City Attorney. Janovec move to approve Petersen as City Attorney with an $800 monthly retainer and hourly rates of pay for any litigation costs. Sanne seconded the motion. Motion carried 4-0.

 

Jeremy Tarr and Bob Smith were appointed as City of Plainview representatives to the Pierce County Economic Development Board. Born moved to approve the appointments. Alder seconded the motion.

 

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #672     

 

Appointment to NMPP Members’ Council

 

NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Plainview, Sate of Nebraska that:

 

  1. Such City be and hereby is a member of the Nebraska Municipal Power Pool.

 

  1. The Mayor and City Council of the City of Plainview, State of Nebraska, does hereby appoint City Administrator, as the representative of the City of Plainview, State of Nebraska, the Members’ Council of the Nebraska Municipal Power Pool.

 

  1. The Mayor and City Council of the City of Plainview, State of Nebraska, does hereby appoint Mayor as the alternate representative of the City of Plainview, State of Nebraska, to the Members’ Council of the Nebraska Municipal Power Pool.

 

Appointment to ACE Board of Directors

 

WHEREAS, the City of Plainview, State of Nebraska, is a party to the Interlocal Agreement creating the Public Alliance for Community Energy and, pursuant to the terms of said Agreement, it is the responsibility of the Mayor and City Council to designate a representative of the City of Plainview to the Public Alliance for Community Energy Board of Directors provided under the terms of said Agreement.

 

NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Plainview, that:

 

  1. The City Clerk is hereby directed to given written notice to the Public Alliance for Community Energy of the appointment of City Administrator as the City’s representative to said Board of Directors.

 

  1. The City Clerk is hereby directed to give written notice to the Public Alliance for Community Energy of the appointment of Mayor as the City’s alternate representative to said Board of Directors.

 

Council member Born seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Born, Janovec, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #672 is passed and adopted.  

 

City Administrator Tarr recommended Kayson Maertins for seasonal park employment. Born moved to approve the hire. Alder seconded the motion. Motion carried 4-0.

 

Sanne moved to approve wages for Kayson Maertins at $11 hourly. Born seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the purchase of the property at 205 N Pine Street from Judy Beaudette to the City of Plainview in the amount of $25,000. Janovec seconded the motion. Motion carried 4-0. The property will be utilized to expand the parking lot for the library and also for a proposed outdoor reading area.

 

Council member Alder stated that he is planning to move to Omaha prior to September of this year. The City will advertise to accept applications for the open council seat.

 

A brief discussion was held on the costs that could be associated with the installation of a new City well. City Administrator Tarr presented the council with a sample $6 million dollar bond payment schedule. Tarr stated that the City could finance the bond payments through increased water rates or a G.O. Bond.

 

City Administrator Tarr briefly discussed items that will need to be determined for the FY 2023-2024 budget including bonds for water and street projects and wages due to the $15 minimum wage that will be mandated by 2026.

 

Born moved to adjourn the meeting. Janovec seconded the motion. Motion carried 4-0
