City Council Meeting January 12, 2021

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY JANUARY 12, 2021

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 12th day of January at 6:30 o’clock P.M. 

.

Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith, Yosten and Sanne. Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Smith moved to approve the special meeting minutes from November 30th and December 28th and the regular meeting minutes from December 8th. Sanne seconded the motion. Motion carried 4-0.

 

Sanne moved to approve claims and payroll. Alder seconded the motion. Motion carried 4-0.

 

No Manor report was given.

 

Police Chief Neumann presented the monthly report for the department. Neumann stated that the county was handling the dog bite that had occurred during the month. Jordan Dietz started his position as a full time Police Officer on January 4th and was training with Neumann and Pierce County Deputies.

 

Susan Norris presented the Economic Development report for December. The DTR Grant Guideline resolution was tabled as information still needed to be sent to DED. Norris would like to have guidelines in place in January in order to allow business applications to start February 1, 2021.

 

City Superintendent Curt Hart updated that nitrate levels were still testing high for the school well and he is working with DHHS to comply with all regulations.

 

Mayor Schlote opened the bids submitted for the City of Plainview trash contractor.

 

The first bid was from Jesse’s Sanitation of Norfolk who submitted a bid for a 5 year contract with rates as follows: Residential (1 tote) $12.00; extra tote $5.00; Commercial (1 tote/dumpster) $20.00

 

The second bid was from the current contractor, Bud’s Sanitary Service of Newman Grove. Their bid was for a 5 year contract at the current rate of $4,752 per month or $57,024 a year.

 

The third bid was receive from Aschoff Garbage of Plainview. They submitted a bid for a 5 year contract at $61,655 per year.

 

Sanne moved to accept the bid from Bud’s Sanitary Service for a 5 year contract. Alder seconded the motion. Motion carried 4-0.

 

A Keno grant application was received from the Plainview TeamMates. Janyce Warneke was present and stated that the money would be used to fund scholarships for the graduating seniors who are currently mentees. Sanne moved to approve the Keno grant in the amount of $1,000. Yosten seconded the motion. Motion carried 4-0.

 

Discussion was held on 2 nuisance properties that were tabled at the December meeting.

 

The first property is located at 105 S King Street, Plainview Pioneer Townsite Co Add Blk 10 Lot 10 and owned by Cindy Schlote. Schlote was present and stated that she had removed several of the items from her property. Chief Neumann stated that adequate cleanup had been completed and it was no longer considered a nuisance. Sanne moved that no action be taken and the property no longer be listed as a nuisance. Smith seconded the motion. Motion carried 4-0.

 

The second property is located at 107 W Locust Ave, Plainview Pacific Townsite Co 1st Add, Blk 10, Lots 16-17-18 and owned by Jeff Ratliff. The council had previously granted the owner a December 1, 2020 deadline for cleanup during the public hearing held on October 13, 2020. Chief Neumann stated that adequate cleanup had not been performed.

 

 

Council member Alder introduction the following resolution and moved for its adoption:

 

RESOLUTION #623

 

 

WHEREAS the City of Plainview has communicated with certain property owners within the City regarding potential Nuisances on their property, as determined by the Board of Health; and

 

WHEREAS various Owners, having been notified according to law, have requested a hearing before the City Council to protest or review those determinations; and

 

WHEREAS the City Council has set and conducted such hearing on the property owned

(legal description) Lot Sixteen (16), Seventeen (17) and Eighteen (18), Block Ten (10), Plainview Pacific Townsite Company’s 1st Addition to the City of Plainview, Pierce County, Nebraska

 

NOW THEREFOR BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, as follows:

 

1.       That the property described above does contain, and is hereby Determined to constitute a Public Nuisance according to City Code;

 

2.      That the Owner of said property is hereby Ordered to remedy said public nuisance by taking the following actions: Proper disposal of all construction debris, iron piles and miscellaneous debris located on property.

 

3.       That said actions shall be completed within the following time frame:  Before February 8th, 2021.

 

4.      That if said actions are not completed as required above, further action shall be taken as follows:  City will assume responsibility for cleaning up the property, bill all charges to the associated owner, Jeff Ratliff, and assess unpaid costs to the property.

 

Council member Smith seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #623 is passed

and adopted.

 

Discussion was held on 3 SDL Liquor license applications that were received from St. Paul’s Catholic Church for their upcoming fish frys. The dates and times submitted were from 4:00 PM to 12:00 AM on February 26th, March 12th and March 26th with alternate dates of March 5th, March 19th and April 2nd. Sanne moved to approve the SDL applications as presented. Yosten seconded the motion. Motion carried 4-0.

 

Discussion was held on Ordinance #961 for proposed water rate increases. The current rate is $14.25 per meter, with $1.70 per 1,000 and $2.00 per 1,000 gallons over 10,000 gallons per month. The proposed rates would increase the base rate to $32.00 with a $2.00 charge per 1,000 gallons. Questions were answered from the audience on budget numbers, comparisons to other Municipalities rates and the necessity for a new well. City Administrator Tarr and City Superintendent Hart stated that the City is working with engineers and the LENRD to identify locations for possible new well. Council members expressed concern on the cost of a new well and how long it would be before nitrate levels would be an issue again. Discussion on the costs for a water treatment plant were held and the council would like City Administrator Tarr to bring back information to the next council meeting comparing costs of the treatment plant and a well.

 

Sanne moved to table Ordinance #961. Smith seconded the motion. Motion carried 4-0.

 

Mayor Schlote tabled discussion on advertising for a City Attorney. Concerns by community members in attendance were heard. Sanne moved to retain Bruce Curtiss as the City Attorney. Smith seconded the motion. Motion carried 3-2. Aye votes received from Sanne, Smith and Schlote. Nay votes received from Yosten and Alder.

 

Council member Sanne urged the council to work together for the best interest of the community.

 

It was moved by Smith, seconded by Sanne to adjourn the meeting. Motion carried 4-0.
