REGULAR MEETING OF THE CITY COUNCIL
TUESDAY, SEPTEMBER 9, 2025
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 9th day of September at 6:30 o’clock P.M.
Roll call was held and present were: Mayor Smith; Council Members: Born, Janovec and Doty Absent: Sanne
The Pledge of Allegiance was then recited.
Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Courtney Retzlaff was present as City Clerk.
Jeremy Tarr was present as City Administrator
Kyle Petersen was present as City Attorney.
Janovec moved to approve the regular meeting minutes from August 12th and the budget workshop minutes from September 4th. Doty seconded the motion. Motion carried 3-0.
Council member Sanne arrived at 6:31 PM.
Janovec moved to approve claims and payroll. Doty seconded the motion. Motion carried 4-0.
No Manor report was given.
Police Chief Hallock reported that she and Officer Funston will be attending the Law Enforcement Conference October 5-8 in Kearney. Regulations for licensing and registering UTV’s, ATV’s and golf carts were discussed.
City Clerk Retzlaff stated that the business loans for Brick Oven & Bakery and Cool Beanz are both finalized.
City Administrator Tarr will get notice of the weekend hours for the transfer station and C&D in September published. Maintenance is removing the old fountain by the swimming pool and working on the dump station for campers.
No City Attorney report.
Council member Sanne introduced the following resolution and moved for its adoption:
RESOLUTION #733
WHEREAS, the Mayor and City of Plainview deem it necessary that Locust Avenue and Main Street are closed to thru traffic from 5:00 PM to 6:30 PM on October 31, 2025 for Downtown Trick or Treating hosted by the Chamber of Commerce;
NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:
- Locust Avenue will be closed from King Street to Elm Street;
- Main Street will be closed from Locust Avenue to Highway 20
Council member Doty seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #733 is passed and adopted.
Council member Sanne introduced the following resolution and moved for its adoption:
RESOLUTION #734
A RESOLUTION TO ADOPT THE LOCAL HAZARD MITIGATION PLAN UPDATE PREPARED BY THE LOWER ELKHORN NATURAL RESOURCES DISTRICT
WHEREAS, the federal Disaster Mitigation Act requires proactive pre-disaster planning as a condition of receiving certain financial assistance under the Robert T. Stafford Act;
WHEREAS, the Lower Elkhorn Natural Resources District, in accordance with the federal Disaster Mitigation Act, has prepared a Local Hazard Mitigation Plan (LHMP);
WHEREAS, the hazard mitigation plan identifies the hazards for the communities within the Lower Elkhorn Natural Resources District, including the City of Plainview;
WHEREAS, the LHMP includes a plan for monitoring, evaluating, and future updates;
WHEREAS, the LHMP was developed through engaging the partners in the process and soliciting input on the existing risks in each community;
WHEREAS, the LHMP is a way to reduce or alleviate the loss of life, personal injury, and property damage that can result from a disaster through long- and short-term strategies; and
WHEREAS, the LHMP prepared by the Lower Elkhorn Natural Resources District will be reviewed and approved by the Nebraska Emergency Management Agency and the Federal Emergency Management Agency.
BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, AS FOLLOWS:
Section 1. The City of Plainview hereby adopts the 2025 Lower Elkhorn Natural Resources District Hazard Mitigation Plan.
Section 2. The City of Plainview will use the adopted and approved portions of the LHMP to guide pre- and post-disaster mitigation of the hazards identified. The City of Plainview will coordinate the strategies identified in the LHMP with other planning programs and mechanisms under its jurisdictional authority. The City of Plainview will continue with its support of the Steering Committee and continue to participate in the Planning Partnership as described by the LHMP. The City of Plainview will help to promote and support the mitigation successes of all LHMP Planning Partners.
Section 3. That all resolutions or parts of resolutions in conflict be and are hereby repealed.
Council member Doty seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #734 is passed and adopted.
Janovec moved to approve Keystone Bar LLC as a sales outlet for the City of Plainview and Nebraska Cooperative Government for Keno. Doty seconded the motion. Motion carried 4-0.
Sanne moved to approve the LB840 recommendation for a sign grant for Northeast Nebraska Diesel Service in the amount of $648.89. Janovec seconded the motion. Motion carried 4-0.
Janovec moved to approve Application for Payment # 2 Project 351-A1-004 Lincoln Avenue and Pine Street paving in the amount of $283,618.09. Doty seconded the motion. Motion carried 4-0.
Sanne moved to approve the payment for Securitas WanderGuard additional costs of $752.85 from the Manor Sales Tax account. Doty seconded the motion. Motion carried 4-0.
Born moved to go into executive session for confidentiality obligations at 6:46 PM. Janovec seconded the motion. Motion carried 4-0.
Born moved to come out of executive session at 6:51 PM. Janovec seconded the motion. Motion carried 4-0.
Janovec moved to approve the Assignment Confirmation for Kaleb Hight as Interim Administrator for Plainview Manor and Whispering Pines Assisted Living. Doty seconded the motion. Motion carried 4-0.
Born moved to approve the demolition and content disposal estimates and asbestos removal costs for the PCSI building in the amount of $22,000 pending final disposal costs for computers, with payments made from the general fund. Doty seconded the motion. Motion carried 4-0.
At 7:00 PM Sanne moved to open the public hearing for a Lot Split at 33 28 4 Plainview College Add Out Lot A T.L. 33. Born seconded the motion. Motion carried 4-0.
City Administrator Tarr explained the lot split and that the Zoning Board had met and recommended the plans as presented.
Sanne moved to close the public hearing at 7:03 PM. Born seconded the motion. Motion carried 4-0.
Sanne moved to approve the Lot Split at 33 28 4 Plainview College Add Out Lot A T.L. 33. Born seconded the motion. Motion carried 4-0.
Discussion on Budget FY 2025-2026 was held. Questions on proposed wage increases and the potential increase for health insurance premiums were addressed. The joint public hearing will be held on September 16 at 6:15 PM at the Plainview Library.
City Administrator Tarr will get notice in the paper for the transfer station and C&D site to be open on Saturday, September 27th from 8:00-11:00 AM. Regular rates will apply and the City Office will be open from 8:00-11:00 AM to take payments that day.
A request for additional barricades for Downtown Trick or Treat was brought to the council’s attention. Request for Child at Play signs will be added to the October council meeting. City Administrator Tarr gave an update on the Lincoln Avenue and Pine Street paving project. The condition of the cabins on Highway 20 was discussed and Chief Hallock will be monitoring the structures.
Sanne moved to adjourn the meeting. Janovec seconded. Motion carried 4-0
